Leaving someone out of a Will

What happens if I leave someone out of my Will?

If you have not properly provided for any of your dependants who are unable to maintain themselves, or if you have not been fair to your spouse (or an ex-spouse who has not remarried), the Court can alter your Will.

The most common cases tend to occur when someone remarries and has new children - you must not omit children from previous marriages if they still have a monetary dependancy on you.

Any reasons for leaving someone out should therefore be given in your Will or in a separate letter which can be referred to in your Will. The Court will then consider these reasons although it will not be bound by them.

Civil Partnerships and your Will

As with marriage, you still need to make a will after registering your partnership as any will you made beforehand becomes invalid.

You will then be recognised under the intestacy rules, and will benefit from the same exemption from inheritance tax as married couples.

If you have existing wills you can either arrange for them to be amended before you register so they allow for the eventuality of a civil partnership, or you can simply have them amended afterwards.

If you choose not to make a Will, your civil partner will inherit under the rules governing intestate estates, which will take into account children from existing or previous relationships.

You are strongly advised to make a new will AFTER entering into a civil partnership.

If you do NOT make a will your partner will only be automatically entitled to the first £125,000.

If you live together but have NOT entered into a civil partnership you must make a will or your partner will receive NOTHING from your estate.

You can make a single will online for £29.95 or a pair of Mirror Wills for £49.95 here

Intestacy Laws England and Wales

Information about what happens to your estate if you die without making a will.

Making a Will is relatively straightforward and not very expensive. However, in spite of this, seven out of ten people in the UK die without a Will. This often causes delays, hardship and worry - and even costly legal bills can result if there is confusion and disagreement among those left behind.

Should you die without a Will or if your Will is deemed to be invalid (e.g. if it wasn’t completed or signed correctly) then you are said to have died intestate.

This results in the law deciding who gets what of your estate.

See the full post for fuller details of who gets what if you don’t make a Will.
