What happens if I leave someone out of my Will?

If you have not properly provided for any of your dependants who are unable to maintain themselves, or if you have not been fair to your spouse (or an ex-spouse who has not remarried), the Court can alter your Will.

The most common cases tend to occur when someone remarries and has new children - you must not omit children from previous marriages if they still have a monetary dependancy on you.

Any reasons for leaving someone out should therefore be given in your Will or in a separate letter which can be referred to in your Will. The Court will then consider these reasons although it will not be bound by them.

Make a Will NOW. If you ever needed a reason to make a will please consider these facts.

Every day over 1500 people die in the UK (source http://www.statistics.gov.uk) and over 70% of them die without making a will.

Much of this is due the the fact that so many people belive that if they die without a will (intestate) that everything will go to their husband or wife. This is NOT true!

It take ten minutes and costs less than £30 to make a fully solicitor checked will online. Make a will online here

If you want any, or even all, of the following to happen then please make a will NOW:-

1. For your money and possessions to go to those pople you WANT them to go to.

2. To reduce the possibilty of financial hardship for your loved ones (not making a will could force the sale of the family home etc)

3. To minimise the effect of Inheritance Tax on your estate.

4. To be able to make specific gifts of treasured or sentimental possesions, or financial gifts to charities.

5. To ensure you have a say in who looks after your children.

6. To choose you own executors who will administer your wishes.

Is it worth even delaying until to tomorrow when you can write and print a fully legal will ONLINE in minutes

As with marriage, you still need to make a will after registering your partnership as any will you made beforehand becomes invalid.

You will then be recognised under the intestacy rules, and will benefit from the same exemption from inheritance tax as married couples.

If you have existing wills you can either arrange for them to be amended before you register so they allow for the eventuality of a civil partnership, or you can simply have them amended afterwards.

If you choose not to make a Will, your civil partner will inherit under the rules governing intestate estates, which will take into account children from existing or previous relationships.

You are strongly advised to make a new will AFTER entering into a civil partnership.

If you do NOT make a will your partner will only be automatically entitled to the first £125,000.

If you live together but have NOT entered into a civil partnership you must make a will or your partner will receive NOTHING from your estate.

You can make a single will online for £29.95 or a pair of Mirror Wills for £49.95 here

You should apoint one or two executors to administer your affairs after your death, although two is usually advisable. An executor is a personal representative, required to act with “utmost good faith” to administer and distribute and estate diligently and correctly’. Many people choose their spouse or children to act as executor.

You should check with each named executor that they are both happy and capable of carrying out the job. Professional executors such as banks, solicitors and accountants will charge fees for their time and these should be checked before you appoint them, especially if they apply a percentage of the estate charge.
